By accessing protected website sections with login credentials, you agree to view confidential and proprietary documents, presentations, financial data/plans and product information subject to copyright and attribution to the owner PeerTribe SA.
These documents and information are Proprietary Information of PeerTribe SA. To avoid the misuse of this Proprietary Information, you agree to use a Confidential treatment for the information obtained and use the information solely to evaluate the business or investment opportunity in Mobyzer’s platform and PeerTribe.
Confidential treatment means that the obtained information cannot be copied, disclosed, made available to a third party, for your economic purposes or for the purposes of a third party.
Associated companies are regarded as third parties. Confidential information may be disclosed or made available to third parties only with the written consent of PeerTribe.
You agree to protect the information obtained with the same degree of care as your own industrial and business secrets, and at least with the care of a prudent business partner. Any employee or consultant given access to any such Proprietary Information must have a legitimate "need to know" and should be known to PeerTribe.
The provisions above shall not apply to any information that you can document is, through no improper action by you or any affiliate, agent, consultant or employee, generally available to the public without any access limitation.
You acknowledge and agrees that due to the unique nature of PeerTribe’s Proprietary Information, there can be no adequate remedy at law for any breach of its obligations under this agreement and that any such breach may cause irreparable harm to PeerTribe. Therefore, upon any such breach or any threat thereof, PeerTribe shall be entitled to appropriate equitable relief in addition to whatever remedies it might have at law and to be indemnified from any loss or harm, in connection with any unauthorized use or release of any such Proprietary Information.
In the event that any of the provisions of this agreement shall be held by a court or other tribunal of competent jurisdiction to be illegal, invalid or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect. This agreement shall be governed by the law of the State of Switzerland without regard to the conflicts of law provisions thereof. Place of jurisdiction is Lugano, Switzerland.
